Article 1 – Definitions

In these terms and conditions the following terms shall have the following meanings:

  1. Reflection period: the period within which the consumer can make use of his right of withdrawal;
  2. Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the entrepreneur;
  3. Day: calendar day;
  4. Duration transaction: a distance contract relating to a series of products and/or services, the supply and/or purchase obligation of which is spread over time;
  5. Durable medium: any instrument which enables the consumer or the entrepreneur to store information addressed personally to him in a way accessible for future consultation and unaltered reproduction of the stored information;
  6. Right of withdrawal: the option for the consumer to cancel the distance contract within the cooling-off period;
  7. Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers;
  8. Distance contract: an agreement concluded between the consumer within the framework of a system organised by the entrepreneur for the distance sale of products and/or services, whereby up to and including the moment the agreement is concluded exclusive use is made of one or more techniques for distance communication;
  9. Distance communication technology: means that can be used to conclude an agreement without the consumer and the entrepreneur being in the same place at the same time;

Article 3 – Applicability

  1. These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
  2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed before the distance contract is concluded that the general terms and conditions are available for inspection at the company and will be sent free of charge to the consumer as soon as possible upon request.
  3. If the distance contract is concluded electronically, notwithstanding the previous paragraph, and before the distance contract is concluded, the text of these general terms and conditions may be made available to the consumer electronically in such a way that the consumer can easily store them on a durable data carrier. If this is not reasonably possible, before the distance contract is concluded, the consumer will be informed where the general terms and conditions can be consulted electronically and that they will be sent free of charge to the consumer electronically or otherwise at the consumer's request.
  4. In the event that specific product or service conditions apply in addition to these general terms and conditions, the second and third paragraphs apply accordingly and, in the event of conflicting general terms and conditions, the consumer can always rely on the applicable provision that is most favourable to him.

Article 4 – The offer

  1. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
  2. The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable the consumer to properly assess the offer. If the entrepreneur uses images, these must be a true representation of the products and/or services offered. Obvious mistakes or errors in the offer are not binding on the entrepreneur.
  3. Each offer contains sufficient information to clearly indicate to the consumer the rights and obligations associated with accepting the offer. This specifically concerns:
    • the price including taxes;
    • any costs of delivery;
    • the manner in which the agreement will be concluded and the actions required for this;
    • whether or not the right of withdrawal applies;
    • the method of payment, delivery and execution of the agreement;
    • the period for accepting the offer, or the period within which the entrepreneur guarantees the price;
    • the amount of the rate for distance communication if the costs of using the distance communication technology are calculated on a basis other than the regular basic rate for the means of communication used;
    • whether the agreement is archived after it has been concluded, and if so, how it can be consulted by the consumer;
    • the manner in which the consumer, before concluding the agreement, can check and, if necessary, correct the data provided by him in connection with the agreement;
    • any other languages in which, in addition to Dutch, the agreement may be concluded;
    • the codes of conduct to which the trader is subject and the manner in which the consumer can consult these codes of conduct electronically;
    • the minimum duration of the distance contract in the case of a long-term transaction.

Article 5 – The Agreement

  1. Subject to the provisions of paragraph 4, the agreement is concluded at the moment the consumer accepts the offer and meets the conditions set therein.
  2. If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of acceptance of the offer electronically. As long as the entrepreneur has not confirmed receipt of this acceptance, the consumer may terminate the agreement.
  3. If the agreement is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a secure web environment. If the consumer can pay electronically, the entrepreneur will implement appropriate security measures.
  4. The entrepreneur may, within legal frameworks, investigate whether the consumer can meet their payment obligations, as well as all the facts and factors relevant to responsibly entering into the distance contract. If, based on this investigation, the entrepreneur has good reason not to enter into the contract, they are entitled to refuse an order or request with reasons or to impose special conditions on its execution.
  5. The entrepreneur will send the following information to the consumer with the product or service, in writing or in such a way that the consumer can store it in an accessible manner on a durable data carrier:
    1. the visiting address of the entrepreneur's establishment where the consumer can go with complaints;
    2. the conditions under which and the manner in which the consumer can exercise the right of withdrawal, or a clear statement regarding the exclusion of the right of withdrawal;
    3. the information about warranties and existing after-sales service;
    4. the information included in Article 4, paragraph 3 of these terms and conditions, unless the entrepreneur has already provided this information to the consumer prior to the execution of the agreement;
    5. the requirements for terminating the agreement if the agreement has a duration of more than one year or is of indefinite duration;
  6. In the case of a long-term transaction, the provision in the previous paragraph only applies to the first delivery.

Article 6 – Right of withdrawal

Upon delivery of products:

When providing services:

  1. When purchasing products, consumers have the right to cancel the agreement without giving reasons within 14 days. This cooling-off period begins on the day after the consumer, or a representative designated in advance by the consumer and notified to the company, receives the product.
  2. During the cooling-off period, the consumer will handle the product and its packaging with care. They will only unpack or use the product to the extent necessary to assess whether they wish to keep it. If they exercise their right of withdrawal, they will return the product with all accessories supplied and – if reasonably possible – in its original condition and packaging to the entrepreneur, in accordance with the reasonable and clear instructions provided by the entrepreneur.
  3. When providing services, the consumer has the option to cancel the contract without giving any reason for at least fourteen days, starting on the day the contract is concluded.
  4. In order to exercise his right of withdrawal, the consumer will follow the reasonable and clear instructions provided by the entrepreneur with the offer and/or at the latest upon delivery.

Article 7 – Costs in case of revocation

  1. If the consumer exercises his right of withdrawal, he will be responsible for at most the costs of return.
  2. If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than 30 days after the return or cancellation.

Article 8 – Exclusion of the right of withdrawal

  1. The entrepreneur can exclude the consumer's right of withdrawal to the extent provided for in paragraphs 2 and 3. The exclusion of the right of withdrawal only applies if the entrepreneur has clearly stated this in the offer, at least in good time before the conclusion of the agreement.
  2. Exclusion of the right of withdrawal is only possible for products:
    1. which have been created by the entrepreneur in accordance with the consumer's specifications;
    2. a. That have been custom-made or engraved by the entrepreneur.
      b. Earrings, for hygienic reasons.
    3. that are clearly personal in nature;
    4. which by their nature cannot be returned;
    5. that can spoil or become outdated quickly;
    6. the price of which is subject to fluctuations in the financial market over which the entrepreneur has no influence;
    7. for individual newspapers and magazines;
    8. for audio and video recordings and computer software of which the consumer has broken the seal.
  3. Exclusion of the right of withdrawal is only possible for services:
    1. concerning accommodation, transport, restaurant business or leisure activities to be performed on a specific date or during a specific period;
    2. the supply of which has begun with the express consent of the consumer before the cooling-off period has expired;
    3. concerning betting and lotteries.

Article 9 – The price

  1. During the validity period stated in the offer, the prices of the products and/or services offered will not be increased, except for price changes due to changes in VAT rates.
  2. Notwithstanding the previous paragraph, the entrepreneur may offer products or services with variable prices, the prices of which are subject to fluctuations in the financial market over which the entrepreneur has no control. This subjection to fluctuations and the fact that any stated prices are target prices will be stated in the offer.
  3. Price increases within 3 months after the conclusion of the agreement are only permitted if they are the result of statutory regulations or provisions.
  4. Price increases from 3 months after the conclusion of the agreement are only permitted if the entrepreneur has stipulated this and:
    1. these are the result of statutory regulations or provisions; or
    2. the consumer has the authority to cancel the agreement with effect from the day on which the price increase takes effect.
  5. The prices stated in the offer of products or services include VAT.

Article 10 – Conformity and Warranty

  1. The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability, and the legal provisions and/or government regulations in force on the date the agreement is concluded. If agreed, the entrepreneur also guarantees that the product is suitable for other than normal use.
  2. A guarantee provided by the entrepreneur, manufacturer or importer does not affect the statutory rights and claims that the consumer can assert against the entrepreneur under the agreement.

Article 11 – Delivery and execution

  1. The entrepreneur will exercise the utmost care when receiving and executing orders for products and when assessing applications for the provision of services.
  2. The place of delivery is the address that the consumer has provided to the company.
  3. Subject to the provisions of Article 4 of these terms and conditions, the company will fulfill accepted orders expeditiously, but no later than 30 days, unless a longer delivery period has been agreed upon. If delivery is delayed, or if an order cannot be fulfilled or can only be partially fulfilled, the consumer will be notified of this no later than 30 days after placing the order. In that case, the consumer has the right to terminate the agreement free of charge and is entitled to any compensation.
  4. In the event of dissolution in accordance with the previous paragraph, the entrepreneur will refund the amount paid by the consumer as soon as possible, but no later than 30 days after dissolution.
  5. If delivery of an ordered product proves impossible, the entrepreneur will endeavor to provide a replacement item. The fact that a replacement item is being delivered will be clearly and comprehensibly communicated at the time of delivery. The right of withdrawal cannot be excluded for replacement items. The costs of any return shipping are borne by the entrepreneur.
  6. The risk of damage and/or loss of products rests with the entrepreneur until the moment of delivery to the consumer or a previously designated representative made known to the entrepreneur, unless expressly agreed otherwise.

Article 13 – Payment

  1. Unless otherwise agreed, amounts owed by the consumer must be paid within 14 days after the start of the cooling-off period as referred to in Article 6 paragraph 1. In the case of an agreement to provide a service, this period commences after the consumer has received confirmation of the agreement.
  2. When selling products to consumers, general terms and conditions may never stipulate an advance payment of more than 50%. If an advance payment is stipulated, the consumer cannot assert any rights regarding the execution of the relevant order or service(s) until the stipulated advance payment has been made.
  3. The consumer has the duty to report any inaccuracies in payment details provided or stated to the entrepreneur without delay.
  4. In the event of non-payment by the consumer, the entrepreneur has the right, subject to legal restrictions, to charge the consumer reasonable costs made known in advance.

Article 14 – Complaints procedure

  1. The entrepreneur has a sufficiently well-known complaints procedure and handles the complaint in accordance with this complaints procedure.
  2. Complaints about the performance of the agreement must be submitted to the entrepreneur within a reasonable time, fully and clearly described, after the consumer has discovered the defects.
  3. Complaints submitted to the entrepreneur will be answered within 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, the entrepreneur will respond within 14 days with a confirmation of receipt and an indication of when the consumer can expect a more detailed response.

Our collection consists of vintage and pre-loved items, so only one of each is available. However, there's a chance a similar piece will be added to the collection in the future!

Materials

Our vintage and pre-loved collection features solid gold jewelry. All our jewelry features natural gemstones (unless otherwise noted). Our jewelry will last for generations to come!

Please note: antique jewelry may be gold-filled. This will always be indicated. Gold-filled jewelry can tarnish over time. Take good care of this historic jewelry, and you'll enjoy it for many years to come.

Gold jewelry is always made from a mix of pure gold and other materials like copper and silver. Pure gold (24 karat) is too soft to make jewelry for everyday use. The number of karats indicates the gold content of a piece of jewelry. The higher the karat, the more pure gold a piece contains. Below are the differences:

8 carat: 333/1000 or 33.3% gold

9 carat: 375/1000 or 37.5% gold

14 carat: 585/1000 or 58.5% gold

18 carat: 750/1000 or 75% gold

The gold content sometimes reveals something about the jewelry's origin. For example, in Germany you'll see jewelry made of 8-carat, in England 9-carat, in the Netherlands 14-carat, and in France 18-carat.

Most of our jewelry is hallmarked. Sometimes a hallmark is no longer clearly visible because the jewelry has been worn. We always perform a gold test using a touchstone and a touchstone. We also test the hardness of the stones in the jewelry to determine their type. This way, you can always be sure you're buying a quality product!

Barse jewelry is known for its colorful gemstones and solid materials like silver, bronze, and copper. All Barse jewelry is handmade using metal casting or the lost-wax method.

Vintage & Pre-loved

Our Golden Hour Vintage jewelry is ready for a second life. It's pre-loved and may therefore show signs of wear. Each piece is unique and special; there's no other piece like it! Please keep in mind that your jewelry isn't new and may contain imperfections such as small scratches, chips, and blemishes. Any defects that could affect the use or quality of an item will always be mentioned. All jewelry is always checked and cleaned before being added to the collection.

Please note: (Vintage) jewelry is a functional item that can always be damaged and requires maintenance. When worn daily, a setting may loosen and/or a stone may become dislodged. Outside of the warranty period, we do not offer solutions/compensation/repairs for such defects. Please keep this in mind when making your purchase!

Warranty

We offer a 30-day warranty from the date of purchase. The warranty expires if a piece of jewelry has been altered or repaired by an outside jeweler or goldsmith.

If there's anything wrong with your jewelry within 30 days of purchase, please email us immediately with a detailed description to info@goldenhourvintage.nl. We'll assess your situation as quickly as possible.

Under warranty, the first priority is always repair. If this isn't possible or the costs are disproportionate, we'll look into a replacement product or you'll receive a credit note.

Please note: a (vintage) piece of jewelry is a practical object that can always be damaged and requires maintenance. When a piece of jewelry is worn daily, a setting may become loose and/or a stone may become detached. Outside of the warranty period, we do not offer any service for such defects. solution/compensation/repairs. Please keep this in mind when making your purchase!

Excluded from warranty:

- When the jewelry has been repaired or adjusted by another party after purchase.

- If the (ring) size of the jewelry turns out to be incorrect after 14 days.

- Damage caused by wearing the jewelry (normal, unavoidable wear and tear)

- Wear and tear caused by wearing jewelry in bed.

- Damage due to falling, impact, breakage, getting stuck, bent ring, etc.

- Loss of stone(s). The setting has been checked, but if the ring is bent, an unfortunate bump to the setting, or a bent prong can cause the stone to fall out of the setting.

- Scratches or cracks on the stone occur after sale.

- Theft or loss of the jewelry.

- Loss of pousettes (backs of studs)

- Discoloration of the jewelry due to chemical products, silver dip, makeup, perfume, hairspray, cleaning agents, skin acid, salt water, chlorine, etc.

If you place your order Monday through Friday before 3:00 PM, your order will be shipped the same day. Shipping costs are calculated at checkout and are free within the Netherlands for orders over €175.

For all orders under €175, shipping costs will be charged:
Netherlands: €7.95
EU (European Union): €12.95
International: €19.95

Is your purchase not quite to your liking? You always have a 14-day cooling-off period after receiving the jewelry. The jewelry must be in the same condition as when you received it. If you wish to return the jewelry, please contact us by email (info@goldenhourvintage.nl). It's also important to keep a shipping confirmation when returning your jewelry. This will prevent any issues with lost shipments. You are responsible for the return shipping costs.

99% of our orders are delivered to PostNL within our "ordered before 3:00 PM, shipped the same day" guarantee. If this is not possible, we will contact you and offer you the opportunity to cancel the purchase. Within the Netherlands, the package will generally be delivered the next day. For Belgium and Luxembourg, delivery takes 1-2 business days with UPS, FedEx, or DHL (but the package will, of course, be shipped the same day if you order before 3:00 PM).

Once we've registered the package with PostNL, you'll receive the track & trace code. It may take some time for the code to become active (on the PostNL website).
